In a similar case to Tyson Foods, Sun-Diamond was fined $1.5 million for giving $6,000 in gifts to Espy. Sun-Diamond won a reversal at the Court of Appeals. Independent Counsel appealed to the Supreme Court. The Supreme Court, in affirming the decision of the Court of Appeals, found that the gratuities statute requires a link between a gift and an official act. Unable to make such a link, Independent Counsel dismissed the gratuities charge against Sun-Diamond. The unanimous opinion of the court, written by Justice Antonin Scalia, stated that the prosecutor's interpretation of the law was so broad that even a high school principal could be in legal trouble for giving a souvenir baseball cap to a visiting Secretary of Education.[3]

Bill Clinton Vanity Fair
In an article published in the July 2008 print edition of Vanity Fair, Bill Clinton is taken to task for his activities since leaving the White House.
The Article
With over 10,000 words, Vanity Fair author Todd Purdum fires off round after round of accusations against former president Bill Clinton. Purdum questions everything about Clinton's post-presidential lifestyle from his various business associations to his jet-set lifestyle. He goes so far as to say that Clinton possesses a "cavernous narcissism".
Clinton's Response
The Clinton response came swiftly, but with no new angles. Clinton chastises Purdum for writing accusations without sources and says that the piece is really just another means to deter his wife, Hillary Clinton, from getting the Democratic Party nomination.
Vanity Fair's Rebuttal
Vanity Fair responded to Clinton's response by standing by its writer. They point out that Clinton failed to point out any factual errors in the article.
They also pointed out that Purdum has been covering the Clintons for over a decade. Not only did Purdum contact former Clinton administrators for the piece, he also contacted Bill Clinton's office prior to publishing the article.

The interesting part of this story is who else was urging Clinton to pardon Marc Rich. The request was delivered to Hillary personally by none other than Scooter Libby, who was Rich's lawyer and has since been convicted of perjury in the Bush administration's leaking of the identity of arms control spy Valerie Plame. And Rich's application was supported by Israel's then-Prime Minister Ehud Barak. The final twist is that Rich was a suspected middleman in smuggling of Iraqi oil despite the trade embargo. His pardon required him to pay a $100 MILLION FINE before he could return to the U.S. That should give conspiracy folks something to chew on.
Clinton also pardoned Almon Glenn Braswell for mail fraud and perjury convictions. Braswell and Carlos Vignali paid approximately $200,000 each to Hillary's brother, Hugh Rodham, to pitch their clemency casese. Rodham returned the payments after they became public knowledge.

WASHINGTON (CNN) -- Vice President Dick Cheney's chief of staff testified Thursday he believes prosecutors of billionaire financier Marc Rich "misconstrued the facts and the law" when they went after Rich on tax evasion charges.
The testimony from Lewis "Scooter" Libby, who represented Rich dating back to 1985 but stopped working for him in the spring of 2000, came during a contentious, hours-long House committee hearing into former President Bill Clinton's eleventh-hour pardons.
